1. Acceptance of Terms

By downloading and using the Brain Battle mobile application (the "App"), you agree to comply with and be legally bound by the terms and conditions of this agreement (the "Terms"). If you do not agree to be bound by these Terms, do not use the App.

Brain Battle reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting to the App. Your continued use of the App after any modifications indicates your acceptance of the revised Terms.

2. License to Use the App

Brain Battle grants you a limited, non-exclusive, non-transferable, and revocable license to use the App solely for your personal, non-commercial purposes. You may not:

• Modify, translate, or create derivative works based on the App
• Reverse engineer, disassemble, or decompile the App
• Copy, rent, lease, or lend the App
• Use the App for any unlawful purpose or in violation of these Terms
• Attempt to gain unauthorized access to the App or its related systems

3. In-App Purchases

The App may offer in-app purchases, including premium content, ad-free experiences, and enhanced features. By making an in-app purchase, you authorize Brain Battle to charge your selected payment method. All sales are final and non-refundable, unless required by applicable law. Brain Battle is not responsible for any unauthorized purchases made on your device.

Prices for in-app purchases are subject to change without notice. Brain Battle will provide notification of price changes through the App or email, and your continued use of the paid features constitutes acceptance of the new pricing.

4. User Responsibilities

You agree to use the App responsibly and in accordance with all applicable laws and regulations. You agree not to:

• Harass, threaten, or abuse other users
• Upload or transmit viruses or malicious code
• Engage in any form of cheating or unfair play
• Violate the intellectual property rights of Brain Battle or others
• Use the App to impersonate others or misrepresent your identity
• Collect or track personal information of others without consent

5. Termination

Brain Battle may suspend or terminate your access to the App at any time, without notice, if:

• You violate these Terms
• You engage in illegal activity
• You breach any agreement with Brain Battle
• Brain Battle believes, in its sole discretion, that your actions may harm the App or other users

Upon termination, your right to use the App immediately ceases. Any data, accounts, or progress associated with your account may be deleted without liability.

6. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. BRAIN BATTLE DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• Merchantability
• Fitness for a particular purpose
• Non-infringement of third-party rights
• Title
• Quality
• Accuracy

Brain Battle does not warrant that the App will be uninterrupted, error-free, or free from viruses or other harmful components.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRAIN BATTLE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFIT, REVENUE, DATA, OR USE, EVEN IF BRAIN BATTLE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Your exclusive remedy for any dissatisfaction with the App is to cease using the App. In no event shall Brain Battle's total liability exceed the amount paid by you, if any, for using the App.

8. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Brain Battle is located, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts in that jurisdiction for the resolution of any disputes arising out of or relating to these Terms or the App.
